## Why a Dismissed Eviction Can Still Get You Denied

We're licensed Texas real estate agents, and we help renters with dismissed evictions across Texas. If your eviction case was dismissed, dropped by the landlord, or ruled in your favor, you probably figured it wouldn’t hurt your next apartment application. Then a SafeRent or other screening report got you denied anyway.

Here's why. The court filing itself stays in the court’s public records no matter how the case ended. In Texas, court records are open to the public by default. Judges rarely seal them, and no Texas law lets you expunge an eviction. Screening software pulls that filing and often flags it as a plain eviction. Dismissed? Judgment? The report may not say.

We handle this two ways. First, we point you to Texas properties that read the full court record instead of going off a flagged summary report. From what we see, those are mostly garden style complexes, mid rises, and Class B communities across Houston, Dallas, Fort Worth, Arlington, Austin, and San Antonio. Second, we help you put together proof of the dismissal so even properties that use standard screening can give your application a real look.

## How Screening Reports Treat Each Kind of Dismissal

Screening doesn't treat every dismissal the same. Here are the main types in Texas, plus a win at trial:

**Dismissed with prejudice:** the landlord can't refile the case. It's the strongest kind of dismissal, and in our placements, many properties will consider it with proof.

**Dismissed without prejudice:** the landlord could technically refile, but we rarely see that happen once time passes. It's the next best spot, though you may need to explain a little more.

**Nonsuit:** the landlord dropped the case on their own. Most of the properties we work with are fine with that, especially when you bring paperwork showing how it ended.

**Judgment for the tenant** (you won at trial): the result we see least often. It isn’t a dismissal, but it’s the best outcome you can have. Include the ruling in your paperwork.

Don't know which kind of dismissal you got? Pull the JP court file directly. Every Texas county’s JP court records are public. Our [guide to checking your history](/guide/how-to-check-your-eviction-history-before-applying/) shows you where to search in the biggest Texas counties.

## What to Bring to Prove a Dismissed Eviction

Bring these to every leasing office:

1. **Order of dismissal** from the JP court (a certified copy is best)
2. **Case disposition summary** (the court record showing how the case ended and the type of dismissal)
3. **Letter of explanation**: two paragraphs, short and honest, no drama
4. **Rental history from after the dismissal** (2+ years clean is best)
5. **Any screening report** you’ve pulled yourself that shows the dismissal correctly. If the report shows “unpaid” or “judgment” instead of “dismissed,” dispute it first.

With our own clients, renters who bring this full package tend to get approved a lot more often than those who don’t. Properties that only look back 2 or 3 years are especially open to a dismissed filing when you show up with proof.

## How to File an FCRA Dispute for a Dismissed Eviction

If your screening report shows the eviction as an active filing and doesn't mention the dismissal, you can dispute it. The [Fair Credit Reporting Act](https://www.law.cornell.edu/uscode/text/15/1681i) gives you that right. Contact the screening company directly (SafeRent, TransUnion, LexisNexis, Experian RentBureau), attach the court’s dismissal order, and put your dispute in writing.

Screening companies have 30 days to look into it, or up to 45 days if you send more information during the first 30. Here’s what usually happens:

- Best case: the report gets updated to show the dismissal, or the filing comes off entirely if it was reported wrong
- Middle case: the filing stays, but the report spells out “dismissed” in the details
- Worst case: nothing changes, and you have to count on someone at each property reading the file by hand

Even the worst case usually helps your odds. You now have paper showing you tried to fix the record, and from what we see, leasing agents notice that.

## Which Texas Apartments Approve Dismissed Filings?

**Independent owners who read the full file:** this is where we look first. We find that owners in Dallas’s Oak Cliff tend to read the whole record. So do owners in suburbs like Haltom City (Fort Worth), Leon Valley (San Antonio), Round Rock (Austin), and Cypress (Houston). When they do, they often approve dismissed filings.

**Class B and mid market properties that make their own call:** we've seen this at some Willow Bridge, RPM Living, and Venterra properties. Bring your paperwork, and they'll often review a dismissed filing by hand. (Willow Bridge is Lincoln Property Company’s former apartment division.)

**Class A, if the dismissal is older and your record since is clean:** some Greystar, MAA, and Cortland properties. We've seen them approve a dismissal that’s 2+ years old when your rental history since then has no problems.

## How Much Does It Cost to Move In With a Dismissed Eviction?

Say your rent is $1,600 a month. Average rents in our cities run about $1,260 to $1,650 a month (RentCafe, September 2026). With a dismissed eviction, here's what to budget:

- Application fee: usually $50 to $85 per adult (HelloData’s 2025 Texas fee data)
- Risk fee: $0 to $250 in the files we see (often waived for dismissals with a strong file)
- Security deposit: we figure 1 to 1.5 months’ rent here ($1,600 to $2,400). Standard deposits in Texas vary a lot, and yours may be lower
- First month’s rent and admin fee: $1,600 plus about $100 (the Texas average admin fee, per HelloData)
- Guarantor (rarely needed): varies by product. Liberty Rent, for example, charges $35 to apply (refunded if you’re not approved), then usually one month’s rent if you’re approved

Total cash to move in with a dismissed eviction: **about $3,350 to $4,450** before any guarantor fee. Want to land at the lower end? It helps to have income of at least 3 times the rent (with pay stubs or tax returns to prove it) and clean rental history since the dismissal. Renters using a guarantor service like OneApp or Rent With CoSign can sometimes bring the upfront deposit down.

## How We Place Renters With Dismissed Evictions

Here's how we handle dismissed eviction cases:

1. Pull your JP court file and confirm what kind of dismissal it was
2. Help you pull your own screening report, so we both see what leasing offices will see
3. If needed, help you file an FCRA dispute to clean up the report
4. Build a target list of properties in your city that read the full court record or review files by hand
5. Put together your proof of dismissal package
6. Coach you on the letter of explanation

We usually see dismissed eviction clients placed within 1 to 2 weeks across Houston, Dallas, Fort Worth, Arlington, Austin, and San Antonio. Ready to start? Fill out the form above.

## Questions About Dismissed Evictions

Straight answers, no legal fluff. Our licensed Texas agents regularly place renters with evictions.

### Why does a dismissed eviction still show on my screening report?

The JP court filing itself stays in the court’s public records no matter how the case ended. In Texas, court records are open to the public by default, and judges rarely seal them. Screening companies like SafeRent and TransUnion pull the filing. They often show it as an eviction flag without saying whether the case was dismissed or went to judgment. Then an automated system can deny you.

### How do I prove a dismissal to a leasing office?

Bring the order of dismissal from the JP court and note whether it was dismissed with or without prejudice. If the landlord dropped the case (a nonsuit) or you and the landlord settled, bring that paperwork too. We help you put this together. Our guide on dismissal denials goes deeper.

### Can I dispute a dismissed eviction on my screening report?

Yes, under the Fair Credit Reporting Act, you can dispute how the filing is described. Screening companies have 30 days to look into it, or up to 45 days if you send more information during the first 30. The outcome we see most: the filing stays, but the report spells out 'dismissed'. See our dispute guide.

### Which Texas properties are best for dismissed evictions?

Properties that do their own screening or set their own rules. From what we see, many Class B mid market properties approve a dismissed filing too when you bring your paperwork. That includes some run by RPM Living and Willow Bridge.

### What proof do I need to show an eviction was dismissed?

Bring the order of dismissal (or nonsuit) from the JP court that heard the case. That one document is your main proof when you ask a screening company to show the case as dismissed instead of a judgment. Attach it to your application and to any FCRA dispute.
